AtMall’s ("AtMall.com", "AtMall BV ",  "we", "us") website(s) (our "Site" or "Sites") and related services are made available to you in accordance with the following TERMS & CONDITIONS, and any other rules posted on our Sites.  

AtMall is a trade name of AtMall BV, a company registered in the Netherlands under registration number 68354134. Our office is registered at the address: Stationsplein 45, Rotterdam, the Netherlands, Our VAT number is NL857407272B01.

Please read these TERMS & CONDITIONS carefully and make sure that you understand them before using the Services. Please note that by using the Services, you agree to be bound by these TERMS & CONDITIONS. If you do not accept these TERMS & CONDITIONS, you will not be able to use the Services and you should leave the Website immediately. If you continue to use the Website or if you order products, we will take this as your acceptance of these TERMS & CONDITIONS.

We may modify the TERMS & CONDITIONS from time to time. Please read the TERMS & CONDITIONS and check back often. If you do not agree to any change to the TERMS & CONDITIONS then you must immediately stop using the Site. If you continue to use the Website or if you order products, we will take this as your acceptance of these TERMS & CONDITIONS.

Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

 

  • Partners

SUPPLYING PARTNER:

Supplying Partner includes Brands Partner and Trading Partner.

Brands Partner is Supplying Partner owning brands/labels, and authorizing AtMall to act as their Europe based Marketing & Sales department/agent for regarding activities. All products from Brands Partners managed by AtMall are marked as Brand Practice under Practice Type.

Trading Partner is Supplying Partner who only supplies products and having AtMall as an agent or intermediary without marketing service agreement from AtMall. All products from Trading Partners without marketing service are marked as Trading Practice under Practice Type.

SERVICE PARTNER:

Service Partner mainly includes Media Marketing Partner (MM Partner) and Logistics Partner. MM Partners are European local medias, Marketing agencies, copywriters or Social media KOLs who could possibly work together with AtMall on project base. Logistics Partner are qualified partners perform a function on transportation, consolidation, fulfilment or clearance on integral strategic level.

  • Registration and Login

To use some of the services or features made available to you on AtMall you will need to register. When you register you are required to provide information about yourself and your business that is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately by login and edit, or via the following e-mail address info@atmall.com. We may also change registration requirements from time to time.

The account password you provide should be unique and kept secure, and you must notify AtMall immediately of any breach of security or unauthorized use of your account.

Different roles of customers’ have customized interphases and pricing policies after login. Please provide accurate information at registration for discretion of Membership, consequently please choose the correct login gateway accordingly.

  • Eligibility to Purchase

In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address, business registration proof if apply, and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site is available especially but not limited to business clients, and others who meet the AtMall terms of eligibility, who have been issued a valid AliPay, WeChat Pay, PayPal, and credit/debit card by a bank acceptable to AtMall, whose applications are acceptable to AtMall and who have authorized AtMall to process a charge or charges on their AliPay, WeChat Pay, PayPal, or credit/debit card in the amount of a partial or total purchase price for the merchandise which they purchase.

By making an offer to purchase merchandise you expressly authorize us to perform credit checks and where AtMall feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use personal information and business information provided by you in order to conduct appropriate anti fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

  • Orders

All orders are subject to acceptance and availability, and items in your shopping cart are not reserved and may be purchased by other customers.

By completing the check-out process and placing an order by clicking the "Place Order" button on the checkout page, you are offering to purchase the products from the relevant Supplying Partner in most cases. All products are marked as Brands Practice or Trading Practice. You should acknowledge that if the products are marked as Brand Practice, the contract concluded upon your purchase is between you and the Brand Partner while AtMall act as a marketing and sales agent; and if the product is marked as Trading Practice, the contract is concluded between you and the Trading Partner, or between you and AtMall if the ownership was transferred to AtMall for an added value service.

Your order for the products is subject to these TERMS & CONDITIONS which are incorporated into the contract between you and the relevant supplying Partners or you and AtMall. All orders are subject to availability and confirmation of the order price and possible re-quote, which are determined by the relevant Partners and AtMall. After entering into the contract for the products with the Partner, the Partner will be under a legal duty to supply you with goods that are in conformity with the contract; if the ownership was transferred to AtMall during the process, AtMall will be under a legal duty to supply you with goods that are in conformity with the contract. Legal title to the product purchased will pass to you upon your payment being accepted. Risk in the product will remain with the Partner and/or AtMall (as applicable) until it is delivered to you at the address specified when you placed your order.

AtMall offers products for sale that are in stock and available for dispatch from our large supplying Partner net. We inspect the supplier qualification to ensure all goods are with a high quality equivalent as European market standard, thus AtMall system will determine on the supplier warehouse based on a most cost efficient algorithm.

Our technology allows multi- warehouses working seamlessly together as one inventory center in order to guarantee the efficiency of consolidation and dispatch; occasionally however, we may be waiting for shipments from some Supplying Partner due to quantity or consolidation restriction.

For customers who placed dropship parcel orders, please carefully check the recipient’s information and please be notified that we cannot be hold responsibility if parcel is hindered or returned by customs due to wrong information eg. ID number from the recipients. All return or retour cost will have to be paid before the parcel can be re-dispatched.

For customers who placed bulk orders, you will always be request to pay a partial amount of the purchasing price and wire transfer followed, against agreement and trading documents.

Please keep in mind that there are chances that certain products are not deliberated to sell in your region so that you might not be able to see the prices of the goods.

  • Pricing Policy

Prices shown on the Site are in EURO, USD or CNY/RMB and are exclusive of VAT at the applicable rate.

All prices and offers remain valid as advertised from time to time. The EURO, USD or CNY/RMB price of a product displayed on the Site at the time the order is accepted will be honored, except in cases of patent error.

From time to time, prices are subject to change in response to currency exchange rate changes, markdowns and other commercial factors. The price applicable to your order will be the price current at the time your order is accepted. Quotation is accepted. Please see Quotation Policy in below point.

Customers purchasing from a country served as DDP will incur relevant import duty and tax. These costs are included in the final purchase price. Customers purchasing from a country served as DDU will be charged for the items purchased and shipping costs only;

If you are a customer whose credit/debit card is not denominated in Euros, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

Since AtMall is registered based on Dutch law, and all supplying Partners on AtMall are located within Europe, all customers without valid EU VAT number purchase with EU legalised payment are entitled with a 21% VAT. All Dutch payment customers are entitled with a 21% VAT.

Shipping costs are mostly not included in the catalogue prices unless it’s remarked so, and if not, it will be charged in addition. The shipping costs (which will include VAT charged by us) will vary depending on the products that you have ordered and your delivery address. The shipping costs applicable to your order will be clearly displayed at checkout before you place your order (and are included in the "Total Cost" amount shown on the order summary page).

Different taxation rules for import duty and tax costs may apply according to different products. We will notify you during the checkout process if import duties are included or you may have to pay them upon receipt of the products. If they are not included, neither we nor the Partner have any control over these charges and we cannot advise on their amount upfront, you will be responsible for payment of any such import duties and taxes that are not included.

Please note that if you return an item, the taxes and import duties will be refunded to you if they were originally included in the purchase price. If they were not included then you will be responsible for reclaiming duty directly from your local customs office or deduced by the cost upon our receiving.

Cross-continent customers should properly register and login AtMall in order to apply B2B pricing and acquire eligible custom documents.

  • Quotation Policy

AtMall is happy to offer a quotation if single purchase is at a high quantity or amount. Customers can simply submit the quotation request from the shopping cart.

  • Acceptance of Your Order

When you place an order, you will receive an email confirming receipt of your order. This email is only an acknowledgement for information purposes and it does not constitute acceptance of your order by the Partner or AtMall. The contract between you and the Partner in relation to the products will not be formed until we have checked and determined which Partner accepts your order. If your order is accepted, we will send you a confirmation email, which concludes the contract between you and the selected Partner based on a best solution. The contract can also be concluded between you and AtMall (itself, or on behalf of the Partner).

The confirmation email will include a description of the products purchased in the order and certain other information about your rights to cancel the contract between you and the Partner, or you and AtMall (itself, or on behalf of the partner). Only those products listed in the dispatch confirmation email are included in the contract concluded.

Unless you cancel your order, acceptance of your order and completion of the contract between you and the Partner, or you and AtMall on behalf of the Partner will be completed when we email you an invoice and shipping notification to confirm the goods have been dispatched. The sale contract is therefore concluded in Rotterdam, the Netherlands and the language of the contract is English or Chinese. None of our suppliers, service partners, or our third party payment processor nor our nominated courier has the authority to accept an order on behalf of AtMall.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the TERMS & CONDITIONS.

Alternatively, we may edit the order with available quantity or sorts for a new order proposal within expected period.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

  • Payment

We accept AliPay, Wechat Pay, PayPal, Visa, MasterCard, and JCB cards, and any other methods that may be clearly advertised on the Site from time to time. When selecting options of PayPal option at checkout, you will be directed to the PayPal site to 'Log In' and review the amount shown before clicking 'Pay Now'. Once this transaction is complete, you will then return to AtMall.com. When selecting AliPay or WeChat Pay, saving the QR code may be required if you are on a smart device; and using smart device to scan the code in order to accomplish the order might be required.

For bulk purchase, only down payment will be required to accomplish via the Site and the rest amount will be required upon bank transfer on a full amount of purchasing value before the goods can be dispatched.

Payment will be debited and cleared from your account upon placing your order by AtMall. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to AtMall, we will not be liable for any delay or non-delivery.

We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using OmniKassa, a secure online payment gateway that encrypts your card details in a secure host environment. If you are a registered AtMall user, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions that you have initiated.

To help ensure that your shopping experience is safe, simple, and secure, AtMall uses Secure Socket Layer (SSL) technology.

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

  • Insurance and Delivery

AtMall insures each purchase during the time it is in transit until it is delivered to your or your customer’s specified delivery address. We require tracking information throughout the whole process from our Logistics Partner for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (eg. your customer, or a gift) then you accept that evidence of tracking is evidence of delivery and fulfilment by AtMall, and transfer of responsibility in the same way. The goods are your responsibility from the time we deliver them to the address you provided us.

Logistics carriers can deliver to certain destinations without collecting a signature. Only service with specification will guarantee on a signature upon receiving; however, we are full process tracking the shipment with our logistic carriers. Nevertheless, please note, that if no signature is collected, you agree to our terms and conditions and, confirm that AtMall can leave your package(s) outside the premises at the shipping address provided by you without obtaining a signature for proof of delivery and take full responsibility for any loss or damage that may occur. On occasion, our carriers may refuse to deliver your order if they are of the opinion that the shipping address is considered to be unsafe.

Please note that we aim to dispatch all orders from our Partners within a most optimized consolidation and dispatch solution during sale periods. Delivery times appearing on the site are estimates and are to be used as a guide only and commence from the date of dispatch. AtMall is not responsible for any delays caused by destination customs clearance processes.

If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and we will provide you a refund for any goods you have paid for but not received.

For bulk purchase, the shipment is always based on CIF terms; Buyers and we are both responsible for reconfirming any quantity difference from the Proforma Invoice before loading. The packing of the goods are preventive from dampness, rust, moisture erosion and shock, and shall be suitable for ocean transportation/ multiple transportation. 3‰ of packaging damage after arrival is under normal transportation wear and tear. For any damage claim above 3‰, the Buyers should supply detailed photos and/or videos, and AtMall will liaise with the Partner on your behalf. AtMall can not be held responsible for any loss or losses due to cause or causes falling within the responsibility of Ship-owners or the Underwriters.

  • Return and exchange

Right to Cancel under the ICACRs

Only if you are based in the EU under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (ICACRs), you have the right to cancel your order with us provided you give us written notice.

You have the right to cancel your order within 14 days without giving any reason.

The cancellation period will expire 14 days from the day after the day on which you (or someone you nominate, other than a carrier) receives the last of the goods. The deadline is met if you send the goods before the period of 14 days has expired.

To exercise the right to cancel, you must inform us by email to: Notice of Contract Cancellation, Customer Care Department, AtMall BV, Stationplein 45, A4,.004 or by email to: info@atmall.com. You may also use the cancellation form, but it is not obligatory.

For orders cancelled under the ICACRs, we will issue you with a full refund including the shipping cost paid by you. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make reimbursement without undue delay, and not later than:(i) 14 days after the day we receive back from you any of the goods supplied; or
(ii)(if earlier) 14 days after the day you provide us with evidence that the good have been returned; or
(iii) if no goods were supplied, 14 days after the day on which we are informed about your cancellation.

We will make reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the re-imbursement.

In the event that we have sent goods to you and you have cancelled your order, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is the earliest. If we do not receive the goods back, we may arrange to have them collected from you at your cost. Thus you will have to bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling, other than what is necessary to establish the nature, characteristics and functioning of the goods.

Please note you may only use your right to cancel the order under the ICACRs if you give us formal written notice of cancellation any time after your order has been placed, up until 14 calendar days from the day after you receive your order, by email or post as described above.

Our policy under the ICACRs

If you cancel an order (or part of an order) during the cooling off period, you must return the product(s) within 14 days after the day on which you notify us of the cancellation, and ensure the item(s) comply with the conditions of our Returns Policy.

If you cancel a contract between us within the 14 day cooling-off period, we will process the refund due to you as soon as possible. In any case your refund will be completed within 14 days after the day on which the Partner received your return, or if earlier, the day on which we receive evidence that you have returned the product(s) to the relevant Partner’s or our service center address.

All returns should be requested before you send your item(s) back to the relevant partner or our service center to allow for easy identification and prompt processing. Unidentified returns will be returned to the sender.

Faulty goods

Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty.

If your item is faulty when you receive it, you can return it for a refund. Simply request a return through your account and send the faulty goods back to us within 30 days of receiving your order.

If you discover a fault after this time, but within six months of purchase, you can still return it. Where possible, we will offer to repair the item. If it cannot be repaired and the same product is still available, we will send you a replacement. If the same product is no longer available, you are entitled to a full refund.

If you would like to exchange a faulty item instead of obtaining a refund, please be aware that we can only replace it for the same product in the same size, subject to availability.

We suggest you email info@atmall.com if any of your purchases have been delivered with packaging un-intact.

Colors

We have made every effort to display as accurately as possible the colors of the products that appear on AtMall. However, as electronic appliance monitors vary, we cannot guarantee that your monitor's display of any color will be completely accurate.

REPEATED RETURNS

We offer a flexible returns policy to make your online shopping experience even easier. We do monitor the number of returns made by customers, and continued returns will be flagged and potentially refused at our discretion or lead to the closure of your AtMall account.

 

NOT ICACRs

If the delivery address is a non-EU address and if an item you have ordered is not as described, is flawed or of a lower quality, you can return it to us and we will liaise with the Partner on your behalf. Once the item is received by the relevant Partner, or us on behalf of the Partner, you will receive a full refund of the defective product, or alternatively a discount, replacement or repair for the item where possible, agreed on a case by case against our description.

BULK PURCHASE

Bulk purchases in pallets or containers are not applicable with above policy. Separate procedure must be activated for any disputes in advance on case base.

  • Intellectual Property Rights (IP rights)

The intellectual property includes copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including AtMall Software and all HTML and other code contained in this Site. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions.

AtMall is authorized and performs as the marketing and sales department for Brand Partners (all related products are marked as Brand Practice) in Chinese market. You are permitted to use the Content as agreed to distribution or as announced or indicated that the contents are for republication. You are allowed to reproduce, copy and/or exploit the Website for affiliate commercial purposes with our prior written consent on the Site. And these situations are more widely used in Chinese language site.

Exaggeration or untrue quote are prohibited and can lead to non-delivery and public warning or legal penalty.

  • Content

In addition to the Intellectual property rights mentioned above, "Content" is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. However, as the descriptions are based on information provided to us by the supplying Partners and media Partners (who remain responsible for them), we cannot guarantee that all details are always accurate, complete or error free. Please contact us if you would like more information about a product. The images of the products on the Website are for illustrative purposes only, and although we attempt to display colours accurately, we cannot guarantee that your computer's display of the images accurately reflect the true colour of the products.

AtMall take the best efforts to keep the website away from virus but we always recommend that all users of the Internet ensure they have up to date virus checking software installed.

AtMall physically interviews and presents brands to their office, showroom or factory. Photos and interview videos represent concept or marketing strategy directly releases from the brands instead of AtMall’s opinion. AtMall studies and provides service to brands on the authenticity and brand essence. AtMall cannot be held responsibility of any possible mis-operation on their own practice in other co-branding platform or media.

AtMall works with numerous European local medias as MM Partner (one sort of Service Partners) in order to carry out a comprehensive and authentic European lifestyle to the rest of the world with a focus in China. Opinions expressed on AtMall Magazines are personal opinions of European local media authors and do not reflect the views of AtMall.

By sharing the contents with signs of allowing to other social medias, you are agreed to grand AtMall to build track links and affiliate links back to Atmall.

By posting you agree to be solely responsible for the content of all information you contribute. You also grant to AtMall a right to use any content you provide for its own purposes including republication in any form or media. Comments may be moderated and may take up to72 hrs to be displayed but AtMall does not commit to checking all content and will not be liable for third party posts. AtMall has not reviewed all of the sites linked to its Web Site and is not responsible for the content or accuracy of any off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.

  • Limits on Our Liability

Nothing in this Agreement is intended to affect your rights under the law.

We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents.

If AtMall fail to comply with the TERMS & CONDITIONS, we are responsible for loss or damage you suffer as a foreseeable result of us breaching the TERMS & CONDITIONS. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract is made, both you and AtMall knew it might happen, for example, if you discussed it with us during the sales process. We will only be liable for loss or damage up to 150% of the total value of goods purchased.

As explained above, in most cases, the contract for the purchase of the products is between you and the relevant Supplying Partner. We are acting as agent or intermediary and authorised by the relevant Partner to conclude the contract on its behalf and you are not purchasing the products directly from us, unless we are entitled to provide added value service to the Partners with a transferred ownership.

We do not allow Partners to offer flawed items or products of lower quality than the corresponding market standards for sale on the Website. If an item you have ordered is not as described, is flawed or of a lower quality, you can return it to us and we will liaise with the Partner on your behalf. Once the item is received by the relevant Partner or us on behalf of the Partner, you will receive a full refund of the defective product, or alternatively a discount, replacement or repair for the item where possible, agreed on a case by case basis by us. We will refund you any applicable delivery charges and any reasonable costs you incur in returning the products (we will advise you whether the products will be collected from you or whether you need to arrange for them to be returned).

We request that all Partners using the Website have and maintain reasonable business policies, which comply with our own business policies. We cannot, however, be responsible for the Partners’ business policies. If you are unhappy with the product or service you have received from a Partner, you should contact us and we will liaise with the relevant Partner on your behalf to try and resolve the issue.

Since we provide service to our supplying Partners in order to deploy a complete supply chain process, it might take longer time to settle the liability and refund procedure. We will email you to inform you the details and period it needs if apply.

We reserve the right to withdraw or amend the Website without notice and, from time to time, we may restrict access to all or parts of the Website. We will not be liable to you if, for any reason, the Website is unavailable at any time or for any period.

We and the Partners will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations to you if such failure or delay is caused by an event outside of our control. An event outside of our control means any act or event beyond our or the Partners reasonable control such as act(s) of wars, terrorist attacks, embargos, riots, strikes, lock-outs, trade disputes, fires, floods, earthquakes or other natural disasters, break-down, inclement weather, interruption of transport, Government action or failure of public or private telecommunications or transport networks. If such an event takes place and it affects the performance of our or the Partners’ obligations to you: (i) we will contact you as soon as reasonably possible to notify you; and (ii) our and the Partners’ obligations to you will be suspended for the duration of the event. Where the event affects delivery of products to you, we will contact you to arrange a new delivery date after the event is over.

We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity).

  • Compensation

At our request, you agree to compensate us fully, defend us, and hold us AtMall harmless immediately on demand, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the TERMS & CONDITIONS by you, including the use by any other persons accessing this Site using your Internet account caused by your action or inaction.

  • Our Relationship

You acknowledge that AtMall acting as agent and is authorised by the relevant Partner to conclude the contract on its behalf and you are not purchasing the products directly from us, unless we are entitled to provide added value service to the Partners with a transferred ownership; consequently you are acknowledged and agree that there can be joint venture, partnership, employment, or agency relationship exists between you and AtMall as a result of the TERMS & CONDITIONS or your use of this Site.

You also acknowledge and agree that AtMall has the discretion to select and choose the suppliers for each order based on most economical solutions, logics or algorithm. AtMall will liaise with the Partner on your behalf for any dispute possibly arisen.

  • No Waiver

If you breach the TERMS & CONDITIONS and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the TERMS & CONDITIONS.

  • Complaints and Governing Law

If you have a complaint about us email info@atmall.com giving full details including date of purchase and order reference number where applicable and your full name and address and contact details.

The TERMS & CONDITIONS together with all our policies and procedures will be governed by and construed in accordance to the Dutch law and the courts in The Hague the Netherlands will have exclusive jurisdiction.

            If any Section of this TERMS & CONDITIONS, (or any term, provision, or clause thereof) is found or held to be invalid or unenforceable in any jurisdiction in which this Agreement is being performed, the remainder of this TERMS & CONDITIONS shall be valid and enforceable; the CUSTOMER and AtMall shall negotiate in good faith, a substitute, valid and enforceable provision which most nearly effects the mutual intent in entering into this TERMS & CONDITIONS yet agreement.
